Unless stated otherwise on a web site, it is implied that EVERYTHING is copyrighted. Just a warning to the wise.

The design (aka the layout) is usually not copyrighted. If you copy the logo or any pictures then you’re in trouble.
you can always follow one website design and thats how every website is being built by following other website design examples. Do not use their content, logo and images, just make it your own and keep a diffrerent color combination.
If you copy the source (html/css) of a website and edit the content than yes. If you try to create something that looks the same than no.
If that website is copyright you can not copy it. Otherwise you can copy it but i suggest to you that you should make some your own changes on that design.And avoid copying logo, Images and Other copyright web contents.
